Question: Where can I find information regarding the notification of a criminal conviction, plea of guilty, plea of nolo contendere, deferred judgment or deferred sentence?
Answer: For information regarding notifying the commission of a conviction, plea of guilty, plea of nolo contendere, deferred judgment, or deferred sentence please see generally, the Colorado Real Estate Manual, and specifically, section 12-10-217, C.R.S. and Commission Rule 6.23.
Question: What are some examples of a criminal conviction, plea of guilty, plea of nolo contendere, deferred judgment, or deferred sentence that needs to be disclosed to the Commission?
Answer: As set forth in section 12-10-217, C.R.S., examples include:
- Offenses Against the Person: homicide, assaults, kidnapping, unlawful sexual behavior, human trafficking and slavery, and stalking
- Offenses against Property: arson, burglary, robbery, and theft
- Offenses involving fraud: forgery, simulation, impersonation, obtaining a signature by deception, offering a false instrument for recording, fraud in obtaining property or services, fraudulent and deceptive sales and business practices, bribery and rigging of contests
- Offenses relating to the Uniform Commercial Code
- Financial transaction device crime act (ATM鈥檚, et. al.)
- Equity skimming
- Identity theft
- Computer crime offenses
- Offenses involving family relations
- Offenses relating to morals
- Governmental operations: specifically bribery and corrupt influences
- Making, financing, or collection of loans
- Colorado Organized Crime Control Act
- Uniform Controlled Substances Act
- Any other like crime under Colorado law, federal law, or the laws of other states
